At last both sides can agree on something! The power of the President to grant pardons is a recipe for corruption!

It's unrealistic to hope that this hangover from the power of the King to pardon (which was transferred to the President in the Constitution) will be abolished; and probably not entirely desirable, either.

But perhaps it should be subject to checks and balances like everything else. But we shouldn't expect Trump and the GOP to accept any restrictions while their man has the top job.

So perhaps we could hope for an amendment to take effect starting from the next transfer of the Presidency in 2029. This might require any Presidential Pardon to not take effect until approved by the House, and endorsed by two thirds of the Senate; just like an impeachment, but in reverse.

But wouldn't it be easier to just abolish it and let the courts be truly independent? Allow a broader range of defences rather than the brain-dead option of immunity; such as 'reasonably necessary to fulfil a vital statutory duty'. Remember that criminal law requires that the prosecution demonstrates 'mens rea' (an awareness that the person accused was indeed aware doing something wrong), and that should remove the need.

American legal doctrine depends too much on 'rights' without regard to context. More thought should be given to pragmatism.

Several Democrats in Congress spoke out today against President Biden’s decision to pardon his son Hunter Biden, who was convicted of gun charges and pleaded guilty to tax charges. The Democrats said it would erode Americans’ faith in democracy and the rule of law.

“The pardon was a mistake,” Representative Jason Crow of Colorado said, adding, “I think it will make it harder for us going forward when we talk about upholding democracy.” Others defended Biden’s move as the justified action of a concerned father who feared that President-elect Donald Trump would follow through on his threats to seek retribution against his rivals.
